About These Terms

These pages explain the general terms applying to the Shearpower2ewe website, enquiries, bookings and services; practical shearing-site and livestock guidance and care; treatment, vaccination and product-record information; and how Shearpower2ewe handles personal information.

Individual properties, livestock and appointments differ. Job-specific details discussed with the client and recorded in the individual appointment correspondence apply to that appointment together with these Terms and any documents supplied.

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded, restricted or modified under the Australian Consumer Law or another applicable law.

Terms & Conditions

1. Website Use

Website information is general information only. Viewing or using the website does not by itself create a confirmed appointment. Service areas, seasonal schedules, availability, travel arrangements and prices may change. Individual appointment arrangements and correspondence apply to the particular job concerned.

2. Enquiries and Client Information

Clients must provide information that is accurate to the best of their knowledge, including relevant contact, property, livestock, access, site, safety and service information. An estimate or appointment may be reviewed where important information is incomplete, inaccurate or changes. Submitting an online form is an enquiry only and does not itself guarantee availability or create a confirmed appointment.

3. Telephone Booking and Appointment Confirmed Email

Appointments are ordinarily discussed and confirmed by telephone. Shearpower2ewe then records the agreed arrangements in the individual appointment correspondence, including the outgoing email with the subject “Shearing & Husbandry APPOINTMENT CONFIRMED”.

The Appointment Confirmed Email may record the appointment date or window, estimated quote, holding fee, on-site/transit fee, cancellation and rescheduling conditions and job-specific information.

The Job Descr or similar field may contain individual information concerning the livestock, site, access, contacts, mustering, yarding, weather, husbandry requirements or other matters relevant to that appointment.

4. Estimates and Individual Jobs

Estimates are based on information available when the appointment is arranged. No two properties, livestock groups or working conditions are necessarily the same.

A quoted or estimated amount may change where livestock numbers, condition, services, mustering, yarding, access, labour, products, equipment or other previously unknown on-site circumstances materially differ from the information supplied. Where reasonably practicable, material additional work or charges will be explained before they are incurred.

5. Holding Fees

A holding fee may be required to secure an appointment. Whether a holding fee is required, the amount required and the due date are discussed for the individual booking and confirmed in the Appointment Confirmed Email. Unless otherwise stated for the individual booking, a paid holding fee will be credited toward the completed service.

6. On-Site & Transit Fees

An on-site and/or transit fee may apply to an appointment. Whether a fee applies and the amount or pricing method will be discussed and/or recorded in the individual appointment arrangements.

7. CANCELLATION OF CONFIRMED APPOINTMENTS

A cancellation fee applies if a confirmed appointment is cancelled beyond the allowable period stated in your confirmation email.

  • Cancellations must be submitted by replying directly to the original confirmation email.
  • The reply must include the phrase "PLEASE CANCEL" in the subject or body.
  • We do not accept cancellations via phone or text message.
  • Your reply must include the original email thread in full for the request to be valid.
  • The applicable fee and cancellation deadline will be stated in your individual confirmation email.

8. Rescheduling

Clients wishing to reschedule should reply directly to the original appointment correspondence with preferred replacement dates or an availability window. Rescheduling is subject to availability, seasonal runs, travel arrangements and the conditions stated for the individual appointment.

9. Payment

Unless approved credit terms apply, payment is due on the day of service, on completion, or immediately upon receipt of the invoice as stated in the applicable payment arrangements. Approved credit accounts must be paid within the period stated on the invoice.

10. Overdue Accounts

Where disclosed before the service and permitted by law, an overdue account may incur the applicable administration fee stated in the Payment Terms and simple interest at 10% per annum (10% per year), calculated daily on the overdue balance.

For avoidance of doubt, the interest rate is 10% per year, not 10% per day.

11. Payment Terms Document

Detailed payment, reminder, cancellation, rescheduling and recovery provisions may also be contained in the current Shearpower2ewe PAYMENT TERMS document supplied with appointment correspondence. The version supplied for the particular appointment should be retained with the client's records.

12A. Photography, Video & Recording On Site

Please obtain permission before photographing, filming or audio-recording Shearpower2ewe personnel, equipment or work activities while services are being carried out. Permission to take an image or recording does not automatically include permission to publish or share it.

12B. Copyright & Permitted Use

Copyright in original Shearpower2ewe website text, policies, terms, guidance, layouts and business materials is reserved by Shearpower2ewe / Stephen Auld, except for material owned by third parties.

Clients and other individuals may print, save or copy this document for their own private, personal and non-commercial reference, including keeping a copy with their Shearpower2ewe service records.

No permission is given to another business, competitor or other person to copy, reproduce, adapt, republish, distribute, incorporate into another website, policy, terms, template or business material, or otherwise use this material for a commercial or business purpose without prior written permission from Shearpower2ewe.

This condition does not limit any use that is permitted by law, including any applicable exception under the Copyright Act 1968 (Cth).

12. Delays Outside Reasonable Control

Mobile livestock services may be affected by weather, fire danger, flooding, road closures, mechanical problems, illness, emergencies, livestock condition, difficult access and other circumstances outside reasonable control. Appointment times and travel estimates may therefore change.

13. Australian Consumer Law

Services supplied by Shearpower2ewe come with consumer guarantees that cannot be excluded where the Australian Consumer Law applies. Nothing in these Terms excludes, restricts or modifies a non-excludable consumer guarantee, legal right or remedy.

Shearing Site, Livestock Guidance & Care

This section provides general preparation, livestock-care and treatment-record guidance. Individual instructions given during the booking process or included in the Appointment Confirmed Email may differ according to the livestock, property, weather and work required.

14. Property, Yards and Work Area

  • Provide safe and reasonable property access for the mobile shearing vehicle and equipment.
  • Livestock must be available, contained and ready for handling when required.
  • Yards, pens, gates and fencing must be reasonably safe and suitable.
  • The working area must provide reasonable footing, space, ventilation and lighting.
  • Known livestock, access, behavioural or site hazards must be disclosed.
  • Children, visitors, uncontrolled animals and unnecessary distractions must be kept clear of the working area.

15. Curfew, Weather and Livestock Dryness

Appropriate curfew, feed, water, shelter and preparation requirements vary according to species, age, size, condition, pregnancy, lactation, weather and other animal-welfare factors. Clients should follow the individual instructions provided for their appointment.

Livestock must be sufficiently dry to be safely handled and shorn. Work may be delayed, modified or rescheduled where livestock or site conditions are unsafe or unsuitable.

16. Animal Welfare and Veterinary Matters

Shearpower2ewe provides livestock-care and husbandry services using reasonable care and skill appropriate to the work being performed. Shearpower2ewe does not provide veterinary diagnosis. Veterinary advice may be recommended where a condition requires veterinary assessment or treatment.

CODES A & B, W/H & ESI

Where livestock treatments or vaccinations are provided, relevant product and treatment information is recorded on the client's invoice and associated Important Notes.

Code “A” identifies relevant treatment information including, where applicable, withholding, export and milking restrictions. Code “B” identifies relevant vaccination/product information.

W/H — Withholding Period: the required period after treatment before livestock may be slaughtered for human consumption. Separate milk restrictions may also apply.

ESI — Export Slaughter Interval: the period that must pass between treatment and slaughter where livestock are intended for an export market.

Clients should retain their invoice and Important Notes as part of the livestock treatment history. These records identify products previously used and will assist with future livestock-management, product-selection and treatment-rotation decisions.

Privacy Policy

17. Purpose

This Privacy Policy explains how Shearpower2ewe collects, records, uses, stores, communicates and protects personal information. Where the Privacy Act 1988 and Australian Privacy Principles apply, Shearpower2ewe will handle personal information in accordance with those requirements. Where they do not apply, this Policy describes the privacy practices Shearpower2ewe intends to follow.

18. Information We May Collect

Information may include names, client numbers, telephone numbers, email addresses, property and service addresses, access/GPS information, livestock and service history, booking details, quotations, invoices, payment information, correspondence, site and safety information, submitted photographs or documents, complaints, communication preferences and consent/unsubscribe records.

19. How and Why Information Is Used

Information may be collected through the website, online forms, telephone, email, SMS, appointment correspondence, in-person contact and previous service records. It may be used to respond to enquiries, quote and schedule work, administer appointments, maintain property and livestock histories, provide services, manage safety and animal welfare, issue invoices, maintain business records, manage complaints and comply with legal obligations.

20. Client Database and Retention

Information may be recorded in Shearpower2ewe's client-management database and associated business records. Records may be retained for as long as reasonably required for service history, livestock treatment history, business continuity, accounting, taxation, insurance, disputes, legal obligations and communication preferences.

21. Service Communications

Shearpower2ewe may send communications reasonably necessary to respond to an enquiry or administer an existing or proposed appointment, including quotes, appointment confirmations, date/time updates, ETA messages, site or weather instructions, invoices and payment communications.

22. Seasonal and Promotional Communications

Seasonal, regional-run, booking-opportunity or promotional email/SMS communications may be sent where the recipient has provided the required consent. Shearpower2ewe will maintain reasonable consent and communication-preference records and will provide an unsubscribe method where required by law.

23. Service Providers

Information may be handled by authorised service providers reasonably required to operate the business, including website/form, email, telecommunications, IT, banking, accounting, insurance, professional-adviser and lawful recovery providers. Some technology providers may process or store information outside Australia.

24. Access, Correction and Privacy Enquiries

A person may request access to personal information held about them or correction of information that is inaccurate or out of date. Reasonable identity verification may be required. Privacy enquiries and requests may be directed using the contact details at the bottom of this page.

25. Changes

These Terms & Conditions, Livestock Guidance & Care and Privacy Policy may be updated when business practices, services, technology or legal requirements change. The current version and effective date will be published on this website.

26. Governing Law

These Terms are governed by the laws applying in New South Wales, Australia, subject to any rights that cannot lawfully be excluded.
